These Terms and Conditions ("Terms") govern your access to and use of Telia's public website, member hub, related mobile APIs, and the music, commerce, community, and account services made available through them (together, the "Service"). By accessing or using the Service, you agree to these Terms.
1. The Service and eligibility
The Service includes:
- Public website: marketing pages, music pages, help/legal pages, and one-off commerce.
- Hub: account access, pricing, subscriptions, billing portal, feed, playlists, and music features.
- Mobile APIs: APIs used by our native mobile application.
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.
2. Accounts and account security
Some features require an account. You must provide accurate information, keep your login details secure, and promptly notify us if you believe your account has been compromised. You are responsible for activity that occurs through your account unless the law says otherwise.
We may suspend, restrict, or terminate accounts that violate these Terms, abuse the Service, infringe rights, or create security or fraud risk.
3. Purchases, subscriptions, billing, and access
One-off purchases
Physical and digital one-off products are sold through the public site. You must provide accurate billing, shipping, and contact details. Availability, pricing, taxes, shipping costs, and any refund information shown at checkout form part of the purchase terms for that order.
Membership subscriptions
Membership subscriptions are sold through the hub. Unless stated otherwise at checkout, subscriptions renew automatically until canceled. Billing, invoicing, payment method updates, and cancellation are handled through Stripe and the billing portal made available through your account.
Access to subscription content depends on the entitlement state recorded in our system. If payment fails, a charge is reversed, a subscription ends, or entitlement is removed for a valid reason, access may be limited or terminated.
Downloads and licensed digital content
Digital products, downloads, streams, and subscription content are licensed to you for personal, non-commercial use. They are not sold to you with ownership of the underlying intellectual property.
4. Feed, playlists, uploads, and user content
The Service may let you post comments, react to content, answer polls, create playlists, upload artwork, avatars, audio, video, images, or other community materials ("User Content").
You retain ownership of User Content you have the right to upload, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, format, display, distribute, moderate, and otherwise use that User Content as necessary to operate, secure, improve, and promote the Service.
You represent that you have the rights needed to submit the User Content and that it does not infringe third-party rights or break the law.
5. Acceptable use and restrictions
You agree not to:
- use the Service unlawfully or in violation of these Terms;
- scrape, crawl, index, or automate access to the Service without our written permission;
- rip, download, redistribute, restream, publicly perform, or commercially exploit protected content without authorization;
- circumvent paywalls, entitlement checks, private media gates, signed URL limits, or other access controls;
- share private links, private media access, or account credentials in a way that bypasses the intended audience or payment model;
- upload malware, harmful code, or content that is abusive, defamatory, infringing, or otherwise unlawful;
- impersonate another person or interfere with the Service, its infrastructure, or other users.
6. Third-party platforms and services
The Service may integrate with or link to third-party services such as Stripe, YouTube, Google, Mux, external streaming platforms, or social/analytics providers. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.
7. Intellectual property
Except for your own User Content and rights granted by law, all software, artwork, recordings, branding, layouts, copy, metadata, and other content available through the Service is owned by or licensed toWalter de Minicis and is protected by intellectual property and other laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use in accordance with these Terms.
8. Moderation, suspension, and termination
We may remove content, restrict visibility, suspend community features, cancel private access, or terminate accounts when we reasonably believe it is necessary to enforce these Terms, comply with law, prevent abuse, protect rights, or keep the Service safe and operational.
You may stop using the Service at any time. If you delete your account, some records may still be retained or anonymized for legal, accounting, security, anti-fraud, moderation, or compliance reasons.
9. Service availability and disclaimers
The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not promise uninterrupted availability, error-free operation, permanent availability of any feature, or compatibility with every device, browser, or third-party service.
Release schedules, content availability, membership perks, and community features may change over time.
10. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, goodwill, data, or business interruption arising from your use of the Service or inability to use it.
To the fullest extent permitted by law, our total liability to you for claims arising out of or relating to the Service or these Terms will not exceed the greater of EUR 100 or the amount you paid us for the specific service giving rise to the claim in the 12 months before the event giving rise to liability.
11. Governing law and disputes
These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. The courts of Genoa, Italy have jurisdiction over disputes that cannot be resolved informally, subject to any mandatory consumer rights that apply where you live.
